1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "User," or "You") and TK Web Solutions, operated by Tarun Singh, based in Bharatpur, Rajasthan, India ("Company," "We," "Us," or "Our").

By accessing or using our website at tkwebsolutions.in, downloading our mobile applications, or engaging us to provide any digital services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you are using our services on behalf of a business, organization, or institution, you represent that you have the authority to bind that entity to these Terms.

3 Mobile Applications & APK Distribution Terms of Use

TK Web Solutions develops custom Android applications distributed via direct APK installation or published on the Google Play Store on behalf of clients.

Demo applications (such as EduPrime) are provided for testing and evaluation purposes. All software code, architecture, and documentation developed by TK Web Solutions are protected under applicable Indian intellectual property laws.

Clients receiving custom application development are granted commercial usage licenses according to their signed project agreement.

4 Pricing & Payment Terms

4.1 Service Pricing & Plans

All prices are in Indian Rupees (INR). Important Meta Advertising Spend Policy: The management fees for Meta Ads cover professional campaign setup, targeting, creative direction, daily optimization, and reporting. The actual advertising budget is paid directly by the client to Meta through the client's own Meta ad account.

4.2 Payment Schedule

• Advance Payment: A minimum of 50% advance payment is required before project work begins.
• Final Payment: The remaining balance is due upon project completion and before the final handover of files and credentials.
• Custom Projects: Payment schedules for large or complex projects may be agreed upon separately in writing.

4.3 Accepted Payment Methods

All payments are processed securely online through Razorpay, our authorized payment gateway partner. Razorpay supports UPI, credit cards, debit cards, net banking, and other major digital payment options within a single secure checkout.

• Razorpay Secure Checkout — UPI, Credit/Debit Cards, Net Banking, and Wallets, all processed through Razorpay's PCI-DSS compliant payment gateway.

5 Project Process & Delivery

5.1 Project Initiation

Every project begins with a free consultation via WhatsApp, phone, or in-person meeting (for Bharatpur-based clients). During this consultation, we discuss requirements, design preferences, budget, and timeline.

5.2 Development & Review

After receiving the advance payment and all required content (text, images, logo, etc.) from the client, we begin development. A preview/demo is shared with the client for review and feedback before final delivery.

5.3 Delivery Timeline

Our standard delivery timeline of 5–7 working days begins from the date of advance payment AND receipt of all required content from the client. Delays caused by incomplete content or delayed client feedback may extend the timeline.

5.4 Post-Delivery Support

All projects include 30 days of free technical support after delivery. This covers bug fixes and minor adjustments. Major feature additions after delivery are charged separately.

5.5 Content Responsibility

The client is responsible for providing all content including text, images, videos, logos, and any other materials. TK Web Solutions is not responsible for factual errors, copyright issues, or legal problems arising from client-provided content.

6 Client Responsibilities

As a client engaging TK Web Solutions, you agree to:

• Provide accurate and complete information about your requirements.
• Supply all required content (text, images, logos) in a timely manner.
• Review and provide feedback on project previews within a reasonable time.
• Make payments according to the agreed schedule.
• Ensure that all content you provide is legally owned by you or that you have appropriate rights to use it.
• Not use any website or app delivered by TK Web Solutions for illegal activities.
• Maintain the security of login credentials provided to you.

7 Intellectual Property Rights

7.1 Client Ownership

Upon full and final payment, the client receives full ownership of the website or app delivered, including all design files and source code created specifically for their project.

7.2 TK Web Solutions Rights

TK Web Solutions retains the right to:

• Display completed projects in our portfolio and on social media as examples of our work.
• Use reusable code components, frameworks, and templates that were not created exclusively for the client's project.
• Retain a "Built by TK Web Solutions" credit link in the website footer, unless the client requests removal (removal may be subject to an additional fee).

7.3 Third-Party Assets

Our websites may use third-party assets such as Google Fonts, Font Awesome icons, open-source JavaScript libraries, and stock images. These are subject to their respective licenses. TK Web Solutions ensures that only properly licensed third-party assets are used.

7.4 Blog Content

All blog articles published on tkwebsolutions.in are the original work of TK Web Solutions unless otherwise credited. You may quote brief excerpts with proper attribution and a link back to the original article.

8 Website Use & Conduct

When using tkwebsolutions.in, you agree to:

• Use the website only for lawful purposes and in a manner that does not infringe the rights of others.
• Not attempt to gain unauthorized access to any part of our website or server.
• Not transmit any harmful, offensive, or malicious code through our website's contact forms or chatbot.

• Business results, sales, or leads generated through websites we build.
• The compatibility of delivered websites with all browsers or devices beyond those tested.

10 Limitation of Liability

To the maximum extent permitted by applicable law, TK Web Solutions and its founder Tarun Singh shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from the use or inability to use our services.
• Loss of business, revenue, data, or profits resulting from any project delivered.
• Any damages caused by third-party services, hosting issues, or domain-related problems.
• Any content provided by the client that causes legal or reputational harm.

In all cases, TK Web Solutions' maximum liability to any client shall not exceed the total amount paid by that client for the specific project in question.

11 Refund Policy

11.1 Advance Payment

Advance payments are generally non-refundable once work has begun, as they cover the time and resources already invested in your project.

11.2 Refund Eligibility

• Full Refund: If TK Web Solutions is unable to start or complete your project due to our own fault, a full refund will be provided.
• Partial Refund: If you cancel a project before significant work has been completed, a partial refund may be considered at our discretion based on work already done.
• No Refund: Once the project is completed and delivered, and the client has approved the final work, no refund will be issued.

11.3 Dispute Resolution

12 Termination

Either party may terminate a service agreement under the following circumstances:

• By the Client: You may cancel a project at any time by notifying us in writing. Refund eligibility is as described in Section 11.
• By TK Web Solutions: We reserve the right to terminate or suspend services if a client violates these Terms, engages in abusive behavior, or requests content that is illegal, offensive, or violates Google's policies.
• Website Access: We reserve the right to terminate or restrict access to our website for users who violate our terms of use.

Termination does not affect any rights or obligations that arose before the termination date.

13 Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Bharatpur, Rajasthan, India.

We encourage clients to contact us directly to resolve any disputes before pursuing formal legal action. We are committed to finding fair and amicable solutions.

14 Changes to These Terms

TK Web Solutions reserves the right to modify these Terms of Service at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Post a notice on our website homepage for at least 7 days.

Your continued use of our website or services after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
